Right to Work Check Amendments

From 22 June 2021, employers will be required to revert to conducting right to work checks in line with the statutory code of practice on preventing illegal working. Please note that these checks are applicable to all new starters including casual and student workers as well as those renewing their visa.

Covid-19 adjusted right to work checks (30/03/20-22/05/21) permitted copies of right to work information and checks via video link, this will no longer be an option. Candidates will instead be advised that their options are to attend in person or via video link (provided we are in receipt of original documents) or have a share code.

It is vital that new starters do not commence work prior to right to work checks taking place. This is very likely to be where the Home Office concentrate audit checks in the coming months.

To note: retrospective checks for those who had covid-19 adjusted checks will not be necessary.
